Ben Mitchel an Associate at Shubin Law Group, where he represents developers, property owners, and investors in complex commercial and land use disputes. He brings a strong litigation background, having represented clients across a wide range of industries – including automotive, financial services, technology, and consumer products – in high-stakes litigation before federal and state courts.

Ben’s early career included significant financial services and antitrust experience, including working as a member of a trial team which secured one of the largest opt-out jury verdicts in U.S. antitrust history. Today, he focuses on real estate and land use litigation, including condominium terminations, common elements disputes, zoning and entitlement challenges, and litigation regarding statutory frameworks such as the Live Local Act and state preemption issues. His clients value his ability to blend courtroom experience with strategic, business-oriented solutions

  • Lead counsel representing a real estate owner and developer in high-profile litigation against a local municipality challenging the denial of a Live Local Act application.
  • Successfully represented the owner of a resort-style hotel condominium in Sunny Isles Beach in litigation brought by the condominium association challenging the governing easement declaration and related assessments. Following dismissal of all claims against our client with prejudice, prevailed in subsequent AAA arbitration, securing a complete award in the client’s favor on all issues concerning the validity and reasonableness of the assessments.
  • Representation of Transit Village, LLC in an ongoing contract dispute with Palm Beach County concerning the enforcement and interpretation of a purchase and sale agreement for County-owned property.
  • Avnet Inc. v. Hitachi Chemical Co., Ltd.: Represented a large distributor of electronic components in federal antitrust price-fixing case. Part of trial team which obtained $267 million trebled jury verdict, considered the largest jury verdict for an opt-out antitrust plaintiff in United States history.* 
  • Discover Growth, LLC v. Clickstream Corporation: Represented lender in action against borrower regarding failure to pay monies owed under negotiable instrument; prevailed on summary judgment.* 
  • EFN West Palm Motor Sales, LLC et al. v. Hyundai Motor America LLC: Member of team which successfully obtained summary judgement in the representation of Hyundai Motor America in high-stakes termination action brought by two dealerships, which alleged that Hyundai wrongfully terminated their dealership agreements.*
  • EMC Mortgage LLC v. Pulte Mortgage, LLC: Represented a loan originator in major financial services litigation brought by financial institutions seeking repurchase/indemnification for large volumes of residential mortgage loans sold prior to the 2008 financial crisis. *
  • Represented several national restaurant chains, as opt-out plaintiffs, in ongoing antitrust litigation against the major United States poultry producers.*
