  • Successfully represented condominium unit owners in litigation challenging the validity of the condominium association’s amendments to a condominium declaration, resulting in a ruling that the amendments to the declaration’s termination provision were invalid and that the retroactive application of the Florida termination statute unconstitutionally impaired contract rights under the declaration. The matter was successfully litigated at both the trial court and appellate levels resulting in the Third District’s Tropicana opinion, which is considered a seminal case in condominium law. Successfully represented the majority owner in the termination of a Miami Beach condominium and subsequent post-termination partition action – considered to be the first post-termination partition action of its kind completed in Florida.
  • Successfully represented the owner of a resort-style hotel condominium in Sunny Isles Beach in litigation brought by the condominium association challenging the governing easement declaration and related assessments. Following dismissal of all claims against our client with prejudice, prevailed in subsequent AAA arbitration, securing a complete award in the client’s favor on all issues concerning the validity and reasonableness of the assessments.
  • Successfully represented Mariner’s Bay Condominium Association before the City of North Miami, which granted the land development approvals necessary to terminate the aging 46-unit waterfront condominium. The approvals from the Planning and Zoning Board and City Council enabled the association to proceed with a bulk sale – a result that now serves as a precedent for similarly-situated condominium associations.
  • Successfully represented an easement parcel owner in litigation brought by a condominium association challenging the validity of the governing easement declaration for a parking garage. Secured victories for the client at both the trial and appellate court levels.
  • Successfully represented the owner of The Bath Club, an exclusive social club on Miami Beach, in connection with litigation against the adjoining condominium association, achieving favorable outcomes at both the trial and appellate court levels.
  • Led the acquisition and subsequent termination of a high-rise condominium in South Florida on behalf of a sophisticated investor-developer, navigating statutory compliance, owner buyouts, and condominium association governance.
